2. Eligibility and your account

• You must be at least 18 years old to place an order.
• You are responsible for keeping your account details secure and for all activity on your account.
• We may refuse or cancel service where permitted by law, including in cases of suspected fraud, abuse or unlawful activity.

3. Orders, pricing and payment

• Listings are invitations to treat, not offers to sell. Orders are subject to acceptance and availability.
• Prices are in Australian dollars and include GST unless stated otherwise.
• We reserve the right to correct pricing or product information errors. If an error affects your order, we will contact you to confirm, change or cancel. If we cancel, we will refund amounts paid.
• Direct deposit: payment must be received within the timeframe stated at checkout or in order emails. Orders are released after funds clear. Use the exact payment reference provided.
• Third-party payment providers may be used. Their terms and privacy policies apply in addition to ours.

4. Shipping, risk and title

• Shipping options, timeframes and charges are shown at checkout or on our Shipping and Returns page.
• Risk in goods passes to you on delivery to your address or on collection. Title passes upon receipt of full payment.
• Delivery timeframes are estimates. We are not responsible for delays caused by carriers or events outside our control.

5. Installation and on-site services

• Provide safe access, accurate site information and required power and water. Hidden or latent conditions may require variations that can impact both time and cost.
• We are not responsible for pre-existing faults or issues caused by third-party equipment or workmanship not supplied by us.

6. Returns, consumer guarantees and warranty

Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.

• You are entitled to a repair, replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they are not of acceptable quality and the failure is not significant.
• Change of mind returns, if offered, are subject to our Returns Policy.
• Manufacturer warranties apply as described by the manufacturer. Unless required by law or related to our workmanship during the workmanship warranty period, labour costs for diagnosis, removal, or reinstallation are not covered.
• Our workmanship warranty is typically 3 months unless stated otherwise in your quote. Labour will be credited during the workmanship period only.
• To lodge a warranty or ACL claim, please contact us with proof of purchase, photos, a detailed description of the issue, and the installation date. Do not remove or return goods until we confirm the process.

7. Website use and intellectual property

• This website and its content are protected by copyright and other rights owned by Bidgee Pumps & Irrigation Pty Ltd or our licensors.
• You may view and print content for personal use only. Do not copy, modify, reverse engineer, scrape, frame, hotlink, or use our trademarks without written permission.

8. Content accuracy

We aim for accurate and current information; however, specifications, colours, and images can vary in real-world use. Check key specifications before purchase or installation.

9. Third-party links and tools

Links to external sites are for convenience only. We do not endorse and are not responsible for third-party content, products or services.

10. Security, viruses and outages

We cannot guarantee that files or data you download are free from viruses or other harmful code. Use suitable security software. The website may be unavailable from time to time due to maintenance or events outside our control.

Do not misuse the site, interfere with its operation, attempt unauthorised access, or use automated means to access or collect data.

You may link to our home page, provided that it is done in a fair, lawful, and non-damaging manner that does not harm our reputation. Do not deep link to protected areas, hotlink images, or imply endorsement without written permission.

15. Promotions, coupons and price match

Promotions and coupons are subject to their stated terms. We reserve the right to withdraw or modify promotions at any time. Any price match commitments are subject to the conditions on our Price Match page.

16. Force majeure

We are not liable for delay or failure to perform due to events beyond our reasonable control. Examples include extreme weather, natural disasters, pandemics, war, labour disputes, utility failures and carrier delays.

17. Termination

We reserve the right to suspend or terminate access if you breach these terms. Sections that by their nature should survive termination will continue to apply.

18. Severability, no waiver and entire agreement

If any part of these terms is unlawful or unenforceable, the remainder stays in effect. Our failure to enforce any right is not a waiver. These terms constitute the entire agreement for the use of our website and online sales, as well as any quote or order confirmation related to your purchase.

19. Governing law and complaints

These terms are governed by the laws of the State of New South Wales and the Commonwealth of Australia. You agree to the exclusive jurisdiction of the courts of New South Wales. If you have a concern or complaint, please contact us first so we can try to resolve it quickly.
